Attorney - Residential Borrower Relations Counsel

SUMMARY:  The Residential Borrower Education Counsel will have direct contact with borrowers and their counsel as well as may supervise a customer service team that assists residential borrowers with selected lender loss mitigation programs.  As part of this function, the incumbent may also manage a small staff of support and clerical employees.

 

ESSENTIAL DUTIES AND RESPONSIBILITIES:  The Residential Borrower Education Counsel will manage, supervise and create certain MGC loss mitigation and educational programs aimed at resolving Borrower issues related to the performance of the loan. The counsel will deal directly with borrower’s counsel to negotiate and document loan restructures.  The incumbent will need to be fluent with residential and consumer lending regulations, loss mitigation strategies as related to consumer bankruptcy.

 

SUPERVISORY RESPONSIBILITIES:  The incumbent may supervise a support and clerical staff.  Staff size will vary depending on future servicing volume.

 

QUALIFICATIONS:    Must have a minimum of 5 to 7 year history with residential and consumer lending, loss mitigation and bankruptcy.  Must be able to supervise professional-level and clerical employees.  Must be an articulate verbal communicator who is also capable of preparing detailed written presentations to senior management and up to the board of director’s level.  Must be comfortable dealing with Borrower’s counsel and engaging in negotiations.

 

EDUCATION and/or EXPERIENCE:  Bachelor’s and law (JD or equivalent) degrees are required.  The incumbent must also be licensed to practice law in one or more states, and have a minimum of 5 to 7 years of relevant experience in private practice or as staff attorney in bankruptcy for a residential loan servicing environment.
