Job Description:
Provide legal advice on employment law issues to the RBC Human Resources Departments and to business line management at RBC's U.S. operations and to manage employment litigation.
Requirements: Basic Qualifications: J.D. with a minimum of 4-8 years of law practice in the employment or labor relations field. Proven self-starter, able to work autonomously (but collaboratively with internal partners) and proactively. Prior litigation experience in administrative or judicial law forums. Demonstrated experience in providing practical advice directly to managers, senior executives and/or clients. Established experience in building effective relationships with internal business partners. Prior experience leading intelligent, aggressive managers through complex legal matters. Demonstrated analytical skills with the ability to break down complex legal matters and expressing them to non-lawyers. Strong written and oral communication skills. Ability to travel as necessary.
Preferred: Experience in-house at a broker-dealer, financial services organization, other securities regulated industry, or bank.
Key Accountabilities:
This position will supervise outside counsel, partner with business line managers on specific matters, assist in keeping the appropriate people and functions informed of the status of those matters, assist in identifying and remedying deficiencies in the firm's practices exposed by the matters, and work to achieve cost-effective resolutions of claims asserted both by and against the firm.
Firm Knowledge of Applicable employment statutes: With employees located throughout the United States, individual will have a firm working knowledge of all employment related federal statutes. Existing familiarity with applicable state employment statutes is preferred, but will be established in position. Working knowledge of NASD procedures preferred.
Document drafting: Drafts or advises on the draft of various HR-related documents such as offer letters, HR policies, employment agreements, termination agreements, settlement agreements and benefit plans. Will be responsible for investigating and responding to administrative inquiries and charge responses in both state and federal administrative agencies.
Litigation management: Investigate new cases, respond to state and federal administrative agencies, participate in administrative hearings and proceedings, manage outside counsel, communicate with the appropriate business line manager, assure compliance with discovery demands, report to senior legal staff, senior firm management and outside regulators.
Contributing to improvement of firm's policies, procedures and practices: The attorney will assist in conveying to the relevant business or functional unit managers (e.g., Human Resources, Compliance) the lessons that may be learned from a case and in developing remedial measures.
Preventive law: Proactively assists HR personnel and business line managers in identifying potential problems.
