Litigation Specialist for Commercial Loans Department
SUMMARY:
Enforce and defend rights in various assets in a nationwide portfolio, including obtaining and realizing upon judgments against obligors. Defend liability suits and counter-claims.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
· Litigation case management from the commencement of case through post-judgment collection or loan disposition. Maintain on-going communication with outside counsel on assigned litigation matters. Review pleadings for factual accuracy of information prior to filing with the Court.
· Review outside counsel invoices on assigned cases for reasonableness and accuracy prior to submission to management for approval and payment.
· Review and evaluate assigned loans, obligor collectability and submit recommendations for consideration by management.
· Attend trials, depositions or mediations as the representative on behalf of MGC Mortgage, Inc.
QUALIFICATIONS:
Must have no less than 10 years litigation experience representing secured creditors. Must have actual first chair trial experience. Must have a working familiarity with: collection law, UFTA, bankruptcy, pre and post judgment remedies and receivers. Some lender liability defense is helpful. Must be able to supervise professional-level and clerical employees. Must be an articulate verbal communicator who is also capable of preparing detailed written presentations to senior management up to board of director’s level.
EDUCATION and/or EXPERIENCE:
Bachelor’s and J.D. degree from an ABA accredited law school. Must be currently licensed and in good standing in one or more states.
LANGUAGE SKILLS:
English proficiency only; no foreign language requirement.
OTHER SKILLS:
Computer skills sufficient to prepare written presentations and to obtain data from loan systems.
REASONING ABILITY:
Must have the ability to manage dynamic work processes and to implement and monitor controls. Must be able to analyze complex legal questions and advise management on potential outcomes and options.
CERTIFICATES, LICENSES, REGISTRATIONS NEEDED:
Must be licensed to practice law in one or more states and member of the appropriate state and local bar associations.
PHYSICAL DEMANDS: General office work only.
WORK ENVIRONMENT: Office environment at servicing facility. Some travel is required.
